
The employer/developer might require the contractor to issue a performance guarantee at the inception of the construction project. This will protect the employer against the contractor’s failure to perform and guarantees the successful completion of the project.

In the case of a late enrolment the NHBRC might require the builder or developer to provide a guarantee for the warranty of the structure because they can not verify whether the builder has complied with their building regulations. This guarantee protects the home owner and NHBRC against structural defects that might arise.

An employer/developer might need to provide a contractor with funds upfront for the successful completion of the project. These guarantees cover the employer and sub-contractors against the contractor’s bankruptcy.

Contractors might need to provide retention guarantees towards the end of the contract to protect the employer against structural defects discovered after the completion of the project and during the maintenance period.
